Willingham, Innocent & Poor

H/t to G.D. at Postbourgie for inspiring me to sit down with the chilling report on the wrongful execution in Texas of an almost certainly innocent man, Cameron Todd Willingham.  The investigation and findings pointing to his innocence, and the likelihood that TX may become the first state in the nation to admit to killing an innocent human being, has been extensively covered in the media and on the blogs - including by Matt at our Criminal Justice blog. (Matt's also got an excellent follow-up post about the declining role of the media as a watchdog.)

I highly recommend reading the original New Yorker article if you have a moment this long weekend.  Like so many wrongfully convicted, Willingham was poor.  At the intersection of poverty and criminal injustice, we need to work to stop the death penalty and improve legal counsel for the indigent.

Willingham was executed in large part due to shoddy representation by his court-appointed lawyers.  Yep, Willingham was too poor to afford his own counsel, and the lawyers charged to represent him never believed he was innocent.  The Innocence Project, which works to overturn wrongful convictions, classifies "bad lawyering" as one of the main causes of wrongful convictions, adding "The resources of the justice system are often stacked against poor defendants."

Willingham's wife was at The Salvation Army getting their three young daughters a Christmas present when the fire caught, likely from faulty wiring or a space heater in their poorly insulated home in Northeast Texas.  For years she maintained his innocence, even after she divorced him.  But "most indigent inmates, like Willingham, who constitute the bulk of those on death row, lack the resources to track down new witnesses or dig up fresh evidence. They must depend on court-appointed lawyers, many of whom are 'unqualified, irresponsible, or overburdened,' as a study by the Texas Defender Service, a nonprofit organization, put it."

Diane wrote this morning about how more and more American households are unable to afford proper arrangements after a loved one dies and are turning to the state for funeral and burial assistance.  We've written previously how the poor have their legal needs fulfilled less than 20% of the time.  But rather than fall onto the fainting couch in despair, consider joining the growing movement to halt the death penalty and fight for equitable, accessible resources for the poor in the criminal justice system.  The Innocence Project lists 10 things you can do to stop wrongful convictions.  The Sentencing Project lists different actions that need your support.  And legal aid societies around the U.S. continually need financial and volunteer assistance.

Fighting for criminal justice reform is fighting poverty.  Take Action Today.  People's lives depend on it.

    Great post Leigh. The desperate need for more public defense resources is a factor in this story that hasn't got enough attention. Willingham had two attorneys assigned to him, but they believed he was guilty and they surely didn't do everything in their power to ensure he got a fair trial. They called one witness: the family babysitter. They failed to challenge the faulty arson science. His trial lasted two days.

    And while arson investigations have improved since Willingham's conviction in 1992, resources for public defense largely have not. Tens of thousands of people are convicted each year in the US after barely seeing their attorneys face-to-face. Very few have the opportunity to hire experts or investigators. This has to change.

    Lawyers For Poor Americans is now actively in the hunt for International Countries and Leaders Worldwide to help raise 5 Billion Dollar$ for our slighted poorer Americans who have had their own American Congress turn their backs on their desperate needs in not affording them proper legal representation.

    Troy Davis and Mumia Abu ~ Jamal are 2 perfect examples of American citizens who never had proper legal representation or defense investigations afforded them by our U.S. Congressional Leaders Of The Free World in their initial criminal trials in (Georgia and Pennsylvania) who might very well have to pay the ultimate price of possibly being completely innocent and falsely executed in the near future.

    These two poorer Americans are among tens of thousands of legal cases nationwide that never were afforded proper legal representation or proper defense investigations at their initial trials……**We the public really have no idea if these men are innocent or guilty until they both are given fair legal representation at their new future trials.

    Improper murder trials take place in Third World Countries all the time. *** Why should average Middle~Class and Working Poor Americans in the Wealthiest Country Of The World be treated as if they are living a Third World Life Style ??

    Gideon vs. Wainwright was not faught by an indigent man for nothing, the poor need to be represented just as the law was written! Incompetent, inaffective counsel is often the only option a poor American has as a choice, I can testify firsthand that If I had an attorney who was competent in the laws surrounding my case and was not concerned about making a dollar I would not be going to Federal Prison for a first time non violent felony!

    Robert F. Kennedy remarked about the case of Gideon vs Wainwright, "If an obscure Florida convict named Clarence Earl Gideon had not sat down in prison with a pencil and paper to write a letter to the Supreme Court; and if the Supreme Court had not taken the trouble to look at the merits in that one crude petition among all the bundles of mail it must receive every day, the vast machinery of American law would have gone on functioning undisturbed. But Gideon did write that letter; the court did look into his case; he was re-tried with the help of competent defense counsel; found not guilty and released from prison after two years of punishment for a crime he did not commit. And the whole course of legal history has been changed."

    Change is always possible!
